Our representation dt 30.04.2024 regarding mandatory e filing,sent to the Honourable CJI & Companion Judges of Supreme and the Honourable CJ& Companion Judges of Madras High Court is still valid.Though discussions had taken place between the High Court E- Commitee and representatives of Bar Associations and various democratic Lawyers' organisations, the vital issues are not considered while implementing now again the project.
Taking away the rights of parties in civil cases and accused in criminal cases from filing very urgent miscellaneous applications/ petitions in physical mode is very arbitrary, unreasonable,unjust and violative of Article 21 of the Constitution of India. Filing urgent miscellaneous petitions during criminal trial for dispensing with the personal appearance of an accused, petition for adjournment of proceedings, defer the cross - examination of witness,etc; is very fundamental to safeguard fair trial.The Honorable Supreme and High Court shall have to fully reconsider the issues and immediately withdraw the present e-filing project implemented by Madras High Court.
